The hearings are conducted by an attorney paid $50 an hour by the tollway to decide whether it is "more likely than not" that a motorist is guilty. Under this civil procedure, the tollway prohibits the hearing officer from considering whether the motorist ever received notification of the alleged offense or whether the toll road's violation detection may have malfunctioned. The only realistic defenses allowed are: "respondent was not the registered owner of the vehicle in question at the time of the violations; or respondent has already paid all of the fines and penalties in full." IPASS units for the past several years are just dumb bricks without any indicators of any sort. The very early IPASS units had alerts and/or indicators, and many of those early units failed. The lanes off to the side (not open road) and the lanes on ramps have indicator lights. I've encountered more than one that was non-functional. Plus, they may see the transponder and indicate all is well anyway . I doubt they have any connection to the account balance system. I would be surprised if they did.
