Essentially, I received a Notice to Owner from Transport for London saying that a parking offence had been committed, and this demanded a payment of �100.00. I did not receive an initial Penalty Charge Notice affixed to my vehicle, or by post (can the PCN be sent by post?), which I would expect to receive first, giving me the opportunity to pay �50.00 within 14 days. Now I may or may not be guilty of the contravention, I just don't recall the situation, but I would probably pay �50.00 just to put the matter to bed (that's what Transport for London want I guess!). But here's what puzzles me. I could wait until a Charge Certificate is issued, increasing the penalty to �150.00, and then the fine is registered at the County Court and I could then swear a Statutory Declaration. One of the grounds for making a Statutory Declaration is that "I did not receive the Notice to Owner". In this context, does "Notice to Owner" mean either a Notice to Owner as I have received, or the initial PCN? In other words, can I validly make a Statutory Declaration saying that I did not receive the *initial* PCN? Or does Notice to Owner mean exactly what it says, such that whether or not you received the PCN, you are in any event liable to pay the �100.00 provided you receive the actual Notice to Owner which I have received? If the latter, does that mean there is no opportunity to pay �50.00 if the first you become aware of an alleged offence is when you are sent a Notice to Owner?
