If the guy drove the car while he was pissed then I'd have no problem with
the coppers dragging him out and executing him on the side of the road.
However, he *didn't* drive the car, and it seems the only reason he was
charged was because the coppers suspected he *might*. Coppers are no more
qualified to make such judgements than you or I, yet for some reason you
seem to think they're able to do so.

I find that pretty strange.

Not "officially", but you'd have to be a pretty dumb copper not to be able
